It should be noted that under the Legal Profession Act 2007 (Qld) (‘LPA’) section 436, the Legal Services Commissioner is obliged to conduct an investigation if a complaint is made and the Commissioner believes that the conduct is capable of amounting to unsatisfactory professional conduct 1 or professional misconduct. 2 The Commission may decline to investigate (or dismiss the complaint) if the complaint is ‘vexatious’ or ‘frivolous’ 3 or for other specified reasons noted in s 432 of the LPA or in circumstances where the complaint is about conduct more than 3 years old. 4

A complaint can be about a legal practitioner, 6 government lawyer, 7 law practice employees, 8 unlawful operators, 9 or any person suspected of contravening the Personal Injuries Proceedings Act 2002 (Qld) regarding advertising and touting. 10
In 2018, the main areas of complaint were in family law and succession matters and the key complaint areas involved costs, communication, conflict and the quality of advice provided. 11 It should be noted that a failure to co-operate with the Commission may in itself amount to unsatisfactory professional conduct or professional misconduct.
